Issuing the Implementing Bylaw of Local Order No. (11) of 2003

Concerning Public Health and Community Safety in the

 Emirate of Dubai[1]

The Director General of the Dubai Municipality,

After perusal of:

Federal Law No. (10) of 2021 Regulating Cemeteries and Burial Procedures;

Local Order No. (11) of 2003 Concerning Public Health and Community Safety in the Emirate of Dubai and its amendments;

Administrative Resolution No. (30) of 2007 Issuing the Implementing Bylaw of Local Order No. (11) of 2003 Concerning Public Health and Community Safety in the Emirate of Dubai and its amendments; and

Administrative Resolution No. (180) of 2017 Amending Administrative Resolution No. (30) of 2007 Issuing the Implementing Bylaw of Local Order No. (11) of 2003 Concerning Public Health and Community Safety in the Emirate of Dubai,

Does hereby issue this Resolution.

Superseded Article

Article (1)

Article (68) of the above-mentioned Resolution No. (30) of 2007 is hereby superseded by the following:

Article (68)

  1. The director of the Competent Department at the Dubai Municipality (the “DM”) may issue permits for the burial or cremation of deceased Foreigners who are non-residents of the Emirate in any of the following cases: 
  1. where the deceased is a newborn baby not registered in the official registry maintained by the competent authority in the Emirate, and one of the parents holds a valid residence permit. However, an exemption from this requirement will be granted if the death occurs at a Healthcare Facility within the Emirate; 
  2. where the deceased held a residence permit issued by the Emirate, or had initiated the procedures to apply for a residence permit and paid the prescribed fees to the competent authority; 
  3. where the deceased is not identifiable through his name, nationality, or religion; or where no identification documents are found on the deceased and a no-objection certificate for the burial has been issued by the Dubai Police;
  4. where the transportation of the body of a deceased Foreigner to outside of the UAE, in accordance with the legislation in force in the UAE, is not feasible due to reasons related to Public Health, such as body decomposition or difficulty in embalming, or due to other factors, such as political conditions, wars, emergencies, crises, or disasters, as established by a report issued by the Dubai Police or the competent healthcare authority in the Emirate;  
  5. where the deceased has died aboard an aircraft that landed in the UAE, or where the departure of the aircraft has been delayed, and it is not possible to transport the body to outside of the UAE. This provision applies to all modes of air, sea, and land transport, subject to a request submitted by the entity controlling the relevant port of entry, through the competent authority supervising that port;
  6. where the deceased has first-degree or second-degree relatives who either hold valid UAE passports or have been issued with initial approvals from the Ruler to be granted the UAE nationality;
  7. where the deceased is a national of a Gulf Cooperation Council member state and resides in the Emirate;
  8. where the deceased was an inmate in any correctional facilities or institutions within the Emirate;
  9. where a judgement is issued by the Dubai Courts authorising the burial of the deceased Foreigner in the Emirate; or
  10. upon receiving requests for the cremation of deceased non-Muslims.
  1. In any event, a deceased may not be buried or cremated without first obtaining the approval of the Dubai Police or the Dubai Public Prosecution, as the case may be.
  2. The Director General of the DM may issue the necessary permits for the burial of deceased Foreigners who are not residents of the Emirate in any other cases as he deems appropriate.

Repeals

Article (2)

The above-mentioned Administrative Resolution No. (180) of 2017 is hereby repealed. Any provision in any other administrative resolution is also hereby repealed to the extent that it contradicts the provisions of this Resolution.

Publication and Commencement

Article (3)

This Resolution will be published in the Official Gazette and will come into force on the day on which it is published.
