Amending

Administrative Resolution No. (30) of 2007 Issuing the

Implementing Bylaw of Local Order No. (11) of 2003 Concerning

Public Health and Community Safety in the Emirate of Dubai[1]

The Director General of the Dubai Municipality,

After perusal of:

The powers legally vested in him pursuant to the decree establishing the Dubai Municipality;

Local Order No. (11) of 2003 Concerning Public Health and Community Safety in the Emirate of Dubai and its amendments; and

Administrative Resolution No. (30) of 2007 Issuing the Implementing Bylaw of Local Order No. (11) of 2003 Concerning Public Health and Community Safety in the Emirate of Dubai, issued on 14 February 2007, and its amendments (the “Original Resolution”),

Does hereby issue this Resolution.

Article (1)

Article (68) of the Original Resolution is hereby superseded by the following:

Article (68)

The Director of the Public Health Services Department may decide to issue a permit for the burial or cremation of the dead body of a non-resident of the Emirate of Dubai only in any of the following cases:

  1. where the deceased was a newborn baby and not registered in the Official Registry, provided that either or both of his parents are residents of the Emirate, as proven by valid residence permits affixed to their passports;
  2. where the residence permit of the deceased is expired, and has not been renewed as a result of any of the diseases precluding the renewal, as proven by a medical report issued by the Dubai Health Authority;
  3. where the deceased is not identifiable, through his name, nationality, or religion; and the dead body has been referred by the Dubai Police based on a letter issued by the Public Prosecution in the Emirate;
  4. where no identification documents are found on the deceased, but his place of residence in the Emirate is confirmed, by identifying his accommodation, house, and residential area; and the dead body has been referred by the Dubai Police based on a letter issued by the Public Prosecution in the Emirate; and
  5. where the transportation of the dead body to outside of the UAE is not feasible, as proven by reports issued by the Dubai Police and the Dubai Health Authority, for reasons related to the prevention of the spread of a contagious disease for the purpose of protection of the Public Health.

Article (2)

This Resolution will form an integral part of the Original Resolution and will be read therewith.

Article (3)

This Resolution comes into force on the day on which it is issued. The Director of the Public Health Services Department must take the actions required for the implementation of this Resolution.
