Mohammed bin Rashid amends Law on the Establishment of Dubai Data Establishment

​In his capacity as Ruler of Dubai, Vice President and Prime Minister of the UAE His Highness Sheikh Mohammed bin Rashid Al Maktoum issued Law No (2) of 2020 partially amending Law No (2) of 2016 on the Establishment of Dubai Data Establishment (DDE).

According to Article (7) of the new Law, The  Director General of Smart Dubai  will undertake  general supervision  of the  work  of  the  DDE  and the  performance  of  its  functions  under  the  Law,  the  resolutions  issued  in  pursuance thereof,  and  the  legislation  in  force  in  the  Emirate.  For this purpose, the Director General of Smart Dubai will have the duties and powers to approve and follow up the implementation of DDE’s general policy, strategic and operational plans; approve DDE’s organizational structure, draft annual budget and final accounts; approve DDE’s projects, programmes, and initiatives; propose the legislation required for the DDE to achieve its objectives; appoint financial auditors and  specialists  in  the  areas  related  to  DDE’s activities and determine their remuneration; approve  partnership  projects  with Government entities and  the  private  sector,  and attract  sponsors  to  fund  the  programmes,  initiatives,  and  projects  implemented  by DDE.

The Director General of Smart Dubai is also responsible for forming  permanent  and  temporary  committees  and  work  teams,  and  determine  their functions and terms of reference and approve DDE’s annual report and submit the same to Dubai Executive Council. The Director General of Smart Dubai may also delegate any of his powers to the CEO, provided that this delegation is specific and in writing.

According to Article (9) of the Law, DDE   will   have   an   executive   body   comprised   of   the   CEO   and   a   number   of administrative, financial, and technical employees. The executive body will be responsible for the operational work, and  for  following  up  the  implementation  of  the  resolutions passed by  the  Director General of Smart Dubai. DDE’s employees will be subject to Dubai Government's Human Resources Management Law No (8) of 2018.

Article (10) of the new Law stipulates that DDE’s  CEO  will  be  appointed  pursuant  to  a  resolution  of  the  Chairman  of  the  Executive Council will be accountable to the Director General of Smart Dubai. The new Law also prescribes the duties and powers of the CEO.

Pursuant to the new Law, the financial resources of the DDE will consist of support allocated to the DDE in the annual budget of Smart Dubai, fees and charges for the services provided by DDE, any other resources secured by the DDE through performing its activities and providing its services and any other resources approved by Dubai Executive Council.

With exception for the decisions issued by the Director General of Smart Dubai pursuant to this Law, the Chairman of Dubai Executive Council will issue all the resolutions required to implement this Law.

The new Law annuls any other legislation that contradict or challenge its articles. The will Law is valid from the date of issuance and will be published in the Official Gazette.
